Terms and Conditions
1) These Terms and Conditions:
a) You should read these terms and conditions carefully before using this web site (the "Site"). By accessing and using the Site you agree to be bound by the terms and conditions set out below. If you do not wish to be bound by these terms and conditions, you may not access or use the Site.
b) These Terms and Conditions may be updated from time to time. At least thirty days prior to any material change, we will notify you by e-mail, at the address you have provided, of the new or different terms and conditions or provide you with a hyperlink to such new or different terms and conditions on the Site. Any such notice will be deemed received when made available to you at the address you have provided. If you continue to use the Site after the effective date of such notice, your continued use of the Site constitutes acceptance of the changes and an agreement to be bound by this agreement, as amended. If you do not agree to the changes, you agree to discontinue your use of the Site
2) Site Content:
Although The StratREAL Foundation (“The Foundation”) has taken all reasonable care to ensure that the information on the Site is current, true and accurate in all material respects and that there are no other material facts the omission of which would make any of the information misleading, The Foundation gives no warranty, express or implied, with regard to the accuracy or currency of the information posted on or downloaded from the Site. In any event information posted on or downloaded from this Site is general in nature, for information purposes only and not intended to constitute advice in any specific situation. If you are in any doubt as to the accuracy and currency of any information posted on or downloaded from the Site, or if you require any further information, please contact The Foundation directly at 020 7287 8772.
3) Site Access:
The Foundation reserves the right to suspend and withdraw access to some or all of the pages of the Site without notice at any time and accepts no responsibility for these pages not being available. The Foundation does not warrant (1) the full functionality of the Site, (2) that defects in the Site will be corrected or (3) that the Site or the server that makes it available is free of viruses or bugs.

a) Where The Foundation provides hypertext links to other web sites or contacts, The Foundation does so for information only and such links do not constitute an endorsement or recommendation by The Foundation of any products or services in such sites. You use such links entirely at your own risk and The Foundation accepts no responsibility for the content or use of such web sites or for the information contained on such sites.

5) Copyright and Use of Content:
a) You acknowledge and agree that, unless otherwise stated, all rights, including copyright, database rights and other intellectual property rights, in the Site and its contents, including logos, graphics, underlying source codes and software, are owned by (or licensed to) The Foundation or otherwise used by The Foundation as permitted by applicable law.
b) In accessing the Site, you agree that you will access the contents solely for your own private use or internal use within your employer's organisation, but not for any commercial or public use or other exploitation. You can download and use the service on a single CPU at a time and you can print out a single hard copy of any part of the content on the Site for your personal use.
c) Except as hereby permitted, you undertake not to copy, store in any medium (including in any other website), distribute, transmit, re-transmit, broadcast, modify or show in public any part of the Site or its content without The Foundation’s prior written permission or in accordance with the Copyright, Designs and Patents Act 1988.
d) You will not remove any copyright or trade mark notice appearing on any copies of Site contents made under these terms and conditions.
e) Any communication or material that you transmit to, or post on any public area of the Site is and will be treated as non-confidential and non-proprietary information.
6) Trade Marks:
a) "STRATREAL” and the “StratREAL Foundation” and associated logos and devices are trade marks of Strategic Real Estate Advisors Limited of Princes House, Suite C, Third Floor, 38 Jermyn Street, London, SW1Y 6DN and are used by The Foundation under licence. The Foundation may claim trade mark and service mark rights in other marks contained within the pages of the Site.
b) Other trade marks and names may be used within the pages of the Site to refer to the entities claiming the marks and names or their products. The Foundation disclaims any proprietary interest in the marks and names of others.
7) Use of the Site:
a) You agree to use the Site in accordance with these Terms and Conditions and only for lawful purposes and in a manner, which does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by any third party. You agree not to import or transfer to the Site either directly or indirectly any information or other content which is or may be inaccurate, misleading, defamatory, obscene or offensive or in breach of any intellectual property right or similar right or damaging to the software or performance of the Site.
b) No right or licence, implied or otherwise, to use the Site or its Contents is granted other than as expressly set out in these Terms and Conditions.
8) Scope of Your Responsibilities:
You are wholly responsible for the use of the Site by any person using your terminal or point of presence and are responsible for ensuring that any such person also fully complies with these terms and conditions.
9) Your Breach:
If you are in breach of these terms and conditions you agree to indemnify The Foundation in respect of any and all losses, costs or damages including reasonable legal fees incurred by The Foundation in relation to or arising out of such breach.
10) Data Protection and Privacy:
a) The Foundation may use the personal information that you provide to ensure that it can give you the best possible service, to provide you with the information and services you request and for The Foundation’s own internal analysis.
b) The Foundation may also disclose your personal information to the extent that we are required to do so by law or to fraud prevention agencies or registries (including the Charities Commission) to help them prevent fraud or to enforce the rights of The Foundation of any of these Terms and Conditions.
c) Where you have consented when providing The Foundation with your details, The Foundation may also contact you from time to time by post, automated telephone call, fax, e-mail and other means to inform you of the activities of The Foundation (which may include activities which it undertakes jointly or in conjunction with other charities [and the activities of other charities]). If you change your mind you can tell The Foundation at any time if you want to stop receiving this information.
d) Please ensure that you only enter your own details. If the information relates to another individual you must obtain the consent of that individual
11) Exclusions and Disclaimers:
a) The Foundation makes no warranties except as set out in these terms and conditions and to the extent permitted by law all other express and implied warranties, terms and conditions are hereby excluded.
b) The Site content is only for your general information and use and is not intended to address your particular requirements. In particular the Site content does not constitute any form of advice, recommendation or arrangement by The Foundation and is not intended to be relied upon by users in making (or refraining from making) any specific decisions.
12) Limitation of Liability:
To the extent permitted by law, The Foundation does not accept any responsibility for any losses or damages whatsoever including, without limitation, direct, indirect, special or consequential loss or damage and/or loss of profits, business revenue, goodwill or anticipated savings arising out of access to or use of or reliance on or inability to access any information posted on the Site or any hypertext or hyperlink to a web site or any information contained on or accessed through such web site.
13) Entire Agreement:
These terms and conditions contain the entire understanding between you and The Foundation with regard to your use of the Site and no representation, statement or inducement, whether oral or written, not contained herein shall bind either you or The Foundation. The Foundation reserves the right to change these terms and conditions from time to time. Use of the Site is subject to the terms and conditions posted on the Site at the time of your visit. If you do not agree to any changes to the terms and conditions then you must immediately stop using the Site. 14) Severability:
Should any part of these terms and conditions for any reason be declared invalid by a court of competent jurisdiction, such determination shall not affect the validity of any remaining portion and such remaining portion shall remain in full force and effect as if the invalid portion of these terms and conditions had been eliminated.
15) Governing Law:
These terms and conditions and your use of the Site are governed by English law. Disputes arising out of these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
